II. SCOPE AND ACCEPTANCE OF TERMS

These General Terms and Conditions (“Terms”) govern all purchases and contractual relationships concluded through the Plydesign webshop.

By placing an order, the customer (“Buyer”) confirms that they have read, understood and accepted these Terms.

These Terms are concluded electronically and constitute a legally binding written contract.

III. CONCLUSION OF THE CONTRACT

1. The Buyer places an order via the webshop.
2. The Seller confirms receipt of the order by email.
3. The contract is concluded upon the Seller’s order confirmation email.
4. Products are manufactured or dispatched only upon receipt of full payment.

Silence or failure to object shall not constitute acceptance.

IV. PRODUCTS AND AVAILABILITY

Images may differ slightly from the final product due to the natural characteristics of wood and production variations. The binding characteristics of each product are described in the relevant product description.

Indicative delivery times:

• In-stock products: approximately 2 weeks
• Made-to-order products: approximately 8–10 weeks

The exact delivery time is confirmed individually by email.

The Seller reserves the right to limit quantities or discontinue products.

V. PRICES AND PAYMENT

• All prices are displayed in EUR and include VAT.
• Payments in HUF are converted at the daily exchange rate of the Hungarian National Bank (MNB).
• Products are shipped or manufactured only upon receipt of full payment.

VI. DELIVERY AND SHIPPING

VI.1. Delivery options

• Personal pickup (Kerta or Budapest showroom, by appointment)
• Courier service or Seller’s own delivery (as agreed)

VI.2. Indicative shipping fees (Hungary)

• 0–5 kg: 8 EUR
• 5–10 kg: 10 EUR
• 10–20 kg: 12 EUR
• 21–30 kg: 18 EUR
• Over 30 kg: 40 EUR

The Buyer must inspect the goods upon delivery and report visible damage without delay.

 

VII. RIGHT OF WITHDRAWAL (EU)

In accordance with Directive 2011/83/EU, consumers have the right to withdraw from the contract without giving any reason within 14 days from receipt of the goods.

To exercise the right of withdrawal, the consumer must inform the Seller by means of a clear statement.

Returned goods must be unused, undamaged and properly packaged.

In the event of withdrawal from the entire order, the Seller shall reimburse all payments received from the consumer, including the cost of standard delivery, without undue delay and no later than 14 days from the date on which the Seller is informed of the withdrawal.

The consumer bears the direct cost of returning the goods.

The Seller may withhold reimbursement until the goods are received back or proof of return is provided. The Seller may withhold reimbursement until the goods are received back or proof of return is provided.

The Seller may reduce the refund to reflect any diminished value of the goods resulting from handling beyond what is necessary to establish their nature and functioning.

VIII. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply to:

• custom-made or personalised goods,
• sealed goods which are not suitable for return for health or hygiene reasons once unsealed,
• goods which are inseparably mixed with other items after delivery,
• sealed audio or video recordings or software once unsealed.

IX. STATUTORY WARRANTY AND GUARANTEE

IX.1. Statutory warranty (EU conformity of goods)

In the event of a lack of conformity, consumers may exercise statutory warranty rights in accordance with Directive (EU) 2019/771 on certain aspects concerning contracts for the sale of goods, as implemented in the applicable national law of the consumer’s habitual residence.

The consumer may request repair or replacement, or, where applicable, a proportionate price reduction or termination of the contract, except where the lack of conformity is minor.

Warranty claims may be asserted within three (3) years from delivery.

Unless otherwise provided by mandatory national law, any lack of conformity becoming apparent within one (1) year from delivery shall be presumed to have existed at the time of delivery.

IX.2. Commercial guarantee

Any commercial guarantee offered by the Seller is voluntary and does not affect the consumer’s statutory rights.

X. DATA PROTECTION

Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and the Seller’s Privacy Policy.

XI. NEWSLETTERS AND MARKETING

Marketing communications are sent only with the consumer’s explicit consent. Consent may be withdrawn at any time.

XII. REVIEWS AND USER CONTENT

User-generated content reflects individual opinions. The Seller reserves the right to remove unlawful or inappropriate content.

XIII. INTELLECTUAL PROPERTY

All content, product designs, images and trademarks are the exclusive property of Plydesign Kft. Any commercial use without prior written consent is prohibited.

XIV. SHOPIFY PLATFORM DISCLAIMER

The webshop is operated using the Shopify platform. All contracts are concluded exclusively between the Buyer and Plydesign Kft. Shopify bears no responsibility for products, fulfilment or disputes.

XV. LIMITATION OF LIABILITY

The Seller shall not be liable for indirect or consequential damages, except where liability cannot be excluded under mandatory law.

XVI. TERMINATION

The Seller may suspend or terminate access to the webshop in the event of misuse or breach of these Terms.

XVII. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by Hungarian law, without prejudice to mandatory consumer protection provisions of the consumer’s country of habitual residence.
